Breathe is a smoking cessation support application designed to help users track their smoking habits, set goals, and practice breathing exercises. The App provides tools for self-monitoring and motivation to support your journey to quit smoking.

The content provided through the App is for informational and educational purposes only. Breathe does not provide medical advice, diagnosis, or treatment recommendations.

• Consult a healthcare professional before starting any smoking cessation program
• Seek immediate medical attention if you experience severe withdrawal symptoms
• Do not disregard professional medical advice because of information you read in the App
• Your use of the App is at your own risk

User Responsibilities

By using the App, you agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or hack the App
• Not use the App in any way that could damage, disable, or impair our services
• Be responsible for maintaining the confidentiality of your device
• Accept that all data is stored locally on your device and you are responsible for backing it up

Intellectual Property

The App and its original content, features, and functionality are owned by Breathe and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or create derivative works of the App
• Distribute, sell, lease, or sublicense the App
• Remove any copyright or proprietary notices
• Transfer the App to another person or "mirror" it on any other server

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free

• Any errors in the App will be corrected
• The App will help you successfully quit smoking

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BREATHE, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content
• Relapse or failure to quit smoking

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law
